Terms of Service

Last updated: Sun 25. Oct

1. Provider and scope

CNS Accounts is run by Aaron Gerkens, operating as a part of CNS Studios, Mittelstraße 79, 22869 Schenefeld, Germany (see the Legal Imprint). These terms apply to your use of CNS Accounts: the account website at https://accounts.cns.ad, the sign-in service at https://api.cns.ad and the CNS Accounts app.

The source code of the CNS Accounts app is published on GitHub under its own license; that license governs the code, these terms govern the service.

2. What CNS Accounts is

CNS Accounts is the central account for services by CNS Studios, such as Sendly. With one account you can sign in to these services, manage your profile, see your devices and activity, and protect your account with two-factor authentication, a recovery phrase and the CNS Accounts app. The service is free of charge.

Each service you sign in to has its own terms, which apply in addition to these. These terms do not give you a claim to the use of any particular service.

3. Who may use CNS Accounts

You must be at least 16 years old. Each account is for one person; you may not share it or sell it. If you use CNS Accounts for an organisation, you confirm that you may act for it.

4. Your account

The agreement between you and us is concluded when you create your account and confirm it with the code sent to your email address. You need a valid email address for this.

Your username, display name and profile picture are visible to other users. They must not:

  • pretend to be another person, organisation or CNS Studios
  • be offensive, discriminatory, sexual or otherwise illegal
  • infringe the rights of others, such as trademarks, copyright or personality rights

You keep all rights in your profile picture. You give us the right we need to store it and show it in CNS Studios services (non-exclusive, worldwide, free of charge, limited to operating the services and ending when you remove it).

5. Keeping your account safe

You are responsible for your credentials and your devices. Use a password you do not use anywhere else, keep it secret, and sign out or revoke devices you lose. We recommend turning on two-factor authentication. If you think someone else has access to your account, change your password, sign out all sessions and tell us.

We store neither your password nor your recovery phrase, and we do not store your email address. There is currently no way to reset a forgotten password by email. Keep your recovery phrase in a safe place: if you lose your password and your recovery phrase, or every device that can approve actions for you, we may be unable to restore your account.

6. Signing in to other services

When you sign in to a service with CNS Accounts, that service receives the data described in the Privacy Policy. You can disconnect a service at any time under Apps. Restricting or deleting your account also ends your access to the services you use with it.

7. The CNS Accounts app

The app is currently available for Android as a public beta. Beta software may contain errors. If you turn on Require Security App, sensitive actions such as signing in, changing your password or deleting your account need approval in the app. Keep the app and the phone it runs on available, and set up a recovery phrase in case you lose them.

8. Acceptable use

You must not:

  • create accounts automatically or in bulk, or create accounts to get around a restriction we imposed
  • sign in to accounts that are not yours, or try to guess passwords or codes
  • circumvent rate limits or other security measures, or attack or disrupt CNS Accounts or other systems
  • probe the service for weaknesses without permission. If you find a security issue, please report it to [email protected] first
  • use CNS Accounts to harass, threaten or defraud people

9. Availability and changes to the service

We do not promise a particular level of availability. We may carry out maintenance and change or add features. We may discontinue CNS Accounts with at least 90 days notice where possible; until then you can ask us for a copy of your data.

10. Reporting illegal content

Anyone, with or without an account, can tell us about a username or profile picture they consider illegal, by email to [email protected]. A notice should contain:

  • an explanation of why the content is illegal
  • which account it is about (the username)
  • your name and email address (not needed for notices about child sexual abuse offences)
  • a statement that you believe the information in the notice is accurate and complete

We confirm receipt, review notices diligently and without arbitrariness, and tell you our decision and how to object to it. Where we become aware of information suggesting a criminal offence that threatens the life or safety of persons, we inform the competent authorities.

11. Our measures

If you violate these terms or the law, or if we receive a valid order, we may remove your profile picture, change a username that breaks section 4, sign out your sessions, lock your account temporarily or permanently, or end the agreement. We act proportionately, consider how serious and how frequent the violation is, and where possible warn you first.

If we restrict your account or remove your content, we tell you what we did and why, whether automated means were used, and how you can challenge the decision, as far as we can reach you. You can contest any decision by emailing [email protected]. A person reviews it and we reply within 1 month. If we do not resolve it, you may also use an out-of-court dispute settlement body certified under Art. 21 DSA or go to the competent court.

If someone frequently submits manifestly unfounded notices, we may, after a prior warning, stop processing their notices for a reasonable period.

12. Ending the agreement

You can end the agreement at any time by deleting your account in the dashboard under Security. This also ends your access to the services you use with it; what happens to your data there is described in their policies.

We can end the agreement with 30 days notice, which we send to you through the service. Our right to end it without notice for good cause, for example a serious or repeated violation of these terms, remains unaffected.

13. Privacy

The Privacy Policy explains how we process personal data.

14. Warranty and liability

CNS Accounts is provided free of charge and 'as is'. We do not guarantee uninterrupted or error-free operation.

We are fully liable for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and where we have given a guarantee. For slight negligence we are liable only for breach of an essential contractual obligation (one that the service depends on and on which you may rely), and then only for the foreseeable damage typical for this kind of service. Otherwise our liability is excluded. These limits also apply to our team members and assistants.

15. Changes to these terms

We may change these terms for good reason, for example new features, legal changes or abuse trends. We will announce changes at least 14 days before they take effect. If you do not agree, you can delete your account before then. Continued use and/or acceptance via a notice in the service after that date counts as acceptance; we will point this out when we announce the change. For changes that fundamentally alter the balance of the agreement we will ask for your explicit consent.

16. Governing law and disputes

German law applies. If you are a consumer, the mandatory consumer protection rules of your country of residence remain unaffected. For merchants the place of jurisdiction is Hamburg. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

17. Final provisions

If a provision is invalid, the others stay in force. Questions about these terms: [email protected].
